ARTICLE 1 - PRICE

1.1 - The prices of our products are given in French Francs, and in Euros, inclusive of VAT excluding contributions to processing and shipment cost. (see Shipment).

1.2 - If you order from a country other than Metropolitan France, you are the importer of the products concerned. The price of products which are shipped outside of the European Union and the Overseas Departments and Overseas Territories is automatically calculated, net of tax, on the invoices. Customs duty or other local taxes and import duties, or State taxes may be payable. Marcoeur.com is not responsible for these paying these charges and sums. You will be responsible for paying them, and you are totally liable for declaring them, and paying them to the competent authorities and/organizations in your country. We advise you to obtain information on these aspects from your local tax and customs authorities.

1.3 - All orders, whatever their origin, are payable in French francs or in Euros.

1.4 - Marcoeur.com reserves the right to modify its prices at any time but the products will be invoiced on the basis of the prices in force when the orders are taken, subject to availability.

The products remain marcoeur.com's property until full payment of the price.

ARTICLE 2 - VALIDATION

QWhen you click on the ‘Validate your order’ button, at the end of the ordering process, you declare that you totally and unreservedly accept the order, as well as all of these General Sale Conditions.

The data recorded by marcoeur.com, is the proof of all of the transactions made by marcoeur.com and its customers.

The data, which are recorded by the payment system, are the proof of the financial transactions.

ARTICLE 3 - AVAILABILITY

Our products are offered within the limits of available stocks.

ARTICLE 4 - LIVRAISON

The products are delivered to the address for delivery which you have indicated in the order process.

The deadlines given are the average deadlines and correspond to the handling and delivery time limits for products for Metropolitan France and Monaco.

ARTICLE 5 - PAYMENT

The payment for your purchases is made by bankcard: Visa, MasterCard, and other Credit Cards.

The card is only debited when the order is shipped.

ARTICLE 6 : SECURITY

We have chosen the Caisse d’Epargne’s SP PLUS secure payment solution to guarantee a control, and a secure transaction over your payments by credit card and by check. Therefore, at the time of payment, you will be in connection with a reputed financial organization in order to process this payment transaction in total security and confidentiality. You therefore exclude any risk of fraudulent use of your means of payment. Your credit card number will only be asked for once you are connected to the Caisse d’Epargne’s secure site (SSL).

ARTICLE 8 - INTELLECTUAL PROPERTY

All of the copyrights as well as all of the intellectual property are reserved over the texts, commentaries, works, illustrations and pictures, which are reproduced on marcoeur.com and marcoeur.net sites for the whole world. As such, and in accordance with the provisions of the Intellectual Property Code, they can only be used for private use, subject to the various, even more restrictive provisions of the Intellectual Property Code. Any other use will be an infringement of these rights and subject to the penalties under the Intellectual Property Code, except with marcoeur.com’s prior authorization.

ARTICLE 9 - LIABILITY

The products, which are offered, conform to the French legislation, which is in force. Marcoeur.com cannot be liable for breach of the legislation of the countries where the products are delivered to (ban on a track). You are responsible for verifying the conditions for importing or using these products or services which you are planning to order with the local authorities.

The photographs and texts, which are reproduced, and illustrate the products presented, are not contractual. Marcoeur.com therefore cannot incur liability if there is a mistake in one of these photographs or texts.

Marcoeur.com will not be liable for non-performance of the contract concluded if there is a stock shortage, or stock is unavailable, force majeure, disruption, all-out or partial strike, notably of the postal and transport and / or communication services, flooding, fire.

Marcoeur.com will not be liable for any consequential loss arising under this document, business interruption loss, loss of profit, loss of a chance, damages or costs.

Marcoeur.com is released from all liability if the content of these sites infringes the legal and regularity provisions which are in force.

ARTICLE 10 - APPLICABLE LAW – DISPUTES

This contract is subject to French law.

The language of this contract is the French language.

Only the French Courts are competent to judge disputes.

Marcoeur.com undertakes not to disclose the information, which you communicate to it to third parties. This information is confidential. It will only be used for processing your order, and for reinforcing the communication to marcoeur.com’s customers, notably through the information letter that you will subscribe to.
